Dr. Zambry: The Legal and Real MB of Perak

 

It is a common thing that a lot of people will always dissatisfy when they lost in some kind of competitions. They tend to be in a denial that they are less good from their opponents who won over them. These "losing people" prefer to find as many excuses as they can by blaming the winning opponents instead to make changes in themselves to be better persons.

Nizar, I must say, has something to say with regard his lost in the Federal Court. 5-0 without any dissenting judgment from they bench that declared Dr. Zambry as the legal and real Menteri Besar of Perak. Previously at the High Court, when Nizar won against Dr. Zambry, he gave compliment to our judiciary saying that justice had been upheld by our court of justice.

Then, after appeal been made by Dr. Zambry before the Court of Appeal and Dr. Zambry won, Nizar started to change his stand towards our judiciary. And in the most recent case, when the Federal Court affirmed the decision made by the Court of Appeal, Nizar's stand may change more and more towards our judiciary  because the court not made a decision in favor of him as happened previously in the High Court.

Now, the court has come to conclusion that Dr. Zambry is the legal and real Menteri besar of Perak. After all, we can see how Perak is developing again since Dr. Zambry became the Menteri Besar after Nizar lost the vote of confidence from the member of State Legislative Assembly.

I truly believe that the court may rely on the case of Stephen Kalong Ningkan where vote of no confidence not necessarily being made in the state Legislative Assembly by rising hands. When there is sufficient evidence showing that a current MB no longer possess the vote of confidence, the he shall no longer the MB. When three MP from PR out from PR and declare themselves as Bebas and declared their supports towards BN, it is sufficient that Nizar at that time  no longer has the majority support in the State Legislative Assembly.

If Nizar believes he still can gain trust from Perak people, I as the Perakian urges him to wait until the next general election.

p/s: Law is complicated somehow. Do you recognize the names like Hart, Fuller, Austin, Bentham or Kelsen? If not, you may want to prevent yourselves from giving to much views of how law is working because law starts with the theory as well as scientific analysis of law. If we're are not in the system, we'll hardly understand how court decision is made because all relevant factor and evidence need to be taken into consideration, not merely the feelings and emotions.
